Legal Pathways to Enter and Stay in the U.S.

Each pathway includes eligibility requirements, application steps, estimated timeframes, and links to USCIS (U.S. Citizenship & Immigration Services) and other official resources.


1. Refugee Status

Definition: Refugees are individuals fleeing persecution based on race, religion, nationality, political opinion, or membership in a particular social group. They apply from outside the U.S. and are processed through the U.S. Refugee Admissions Program (USRAP).

Steps & Estimated Timeframe:

  1. Register with the UNHCR (United Nations High Commissioner for Refugees)

    • Refugees apply through UNHCR or a U.S. embassy in a foreign country.

    • Timeframe: Several months to years (depends on eligibility and country of origin).

  2. Referral to U.S. Refugee Admissions Program (USRAP)

    • UNHCR refers eligible cases to USRAP, which conducts interviews, background checks, and medical screenings.

    • Timeframe: 6 months–2 years.

  3. Approval & Resettlement in the U.S.

    • If approved, the refugee is assigned to a resettlement agency and receives assistance.

    • Timeframe: 2–6 months for final processing and travel to the U.S.

2. Asylum Seekers

Definition: Asylum seekers are individuals already in the U.S. or arriving at the border seeking protection due to persecution fears. Unlike refugees, asylum seekers do not apply from outside the U.S.

Steps & Estimated Timeframe:

  1. Enter the U.S. & File Form I-589 (Application for Asylum) Within One Year

    • Applicants can enter with a visa or present themselves at the border.

    • Timeframe: 6 months to 5+ years (due to backlog).

  2. Attend Biometrics Appointment

    • Timeframe: 4–8 weeks after filing.

  3. Asylum Interview (Affirmative Process) or Immigration Court Hearing (Defensive Process)

    • Affirmative asylum seekers are interviewed by a USCIS officer.

    • Defensive asylum seekers go to an immigration court.

    • Timeframe: 6 months to 3+ years depending on backlog.

  4. Receive Decision

    • Timeframe: 2 months to several years after the interview.

  5. Apply for Work Permit (EAD) - Form I-765

  6. Apply for a Green Card (After 1 Year of Asylum Approval)

3. Parole Status (Humanitarian or Public Interest)

Definition: Parole allows individuals to enter the U.S. temporarily without a visa due to urgent humanitarian reasons or significant public benefit.

Steps & Estimated Timeframe:

  1. File Form I-131 (Application for Parole)

  2. USCIS Review & Decision

    • Timeframe: 2–12 months.

  3. Parole Approval & Entry to the U.S.

    • Parole is usually granted for 1–2 years.

  4. Apply for Work Authorization (if eligible)

  5. Adjustment of Status (If Eligible)

    • Some parolees can later apply for asylum, a visa, or a green card.

4. Temporary Protected Status (TPS)

Definition: Provides temporary legal status to nationals from designated countries affected by war, disasters, or humanitarian crises.

Steps & Estimated Timeframe:

  1. Check TPS Designation for Your Country

  2. File Form I-821 (TPS Application) & Form I-765 (Work Permit, If Needed)

  3. Attend Biometrics Appointment & USCIS Review

    • Timeframe: Several months.

  4. Renew TPS as Needed

    • Timeframe: Renewal required every 6–18 months depending on country status.

Total Estimated Time: 6 months–1 year


5. Family-Based Immigration (Sponsorship)

Definition: U.S. citizens and green card holders can sponsor certain family members for legal entry and residency.

Steps & Estimated Timeframe:

  1. Sponsor Files Form I-130 (Petition for Alien Relative)

  2. Wait for Visa Availability

  3. Apply for Green Card (Form I-485 or Consular Processing)

Total Estimated Time: 1–20+ years
